MONEYFITT TERMS AND CONDITIONS

INTRODUCTION

Welcome to MoneyFitt, operated by ProConnect Technologies Pte Ltd at 32 Pekin Street, #05-01, Singapore (048762). These Terms & Conditions ("T&C") govern your use of the MoneyFitt platform (“Platform”), which matches users (“Users”) with third-party financial advisors (“Advisors”).

MoneyFitt is a neutral technology platform and does not provide financial advice. All services are provided solely by independent Advisors, and MoneyFitt disclaims liability for their actions, advice, or services.

By using the Platform, you agree to these T&C, forming a legally binding agreement with ProConnect Technologies Pte Ltd. If you disagree with any part of these T&C, please discontinue use. Users must be 18 or older and register with a valid email and name. For inquiries and questions, contact us at hello@moneyfitt.co.

DEFINITIONS

For the purposes of these T&C, the following definitions apply:

• Platform refers to all digital services provided by MoneyFitt, including websites, mobile applications, and other technology tools.
• User refers to any individual accessing or using the Platform.
• Advisor refers to a third-party financial professional, unaffiliated with MoneyFitt, who is registered on the Platform to offer advice or services to Users.
• AI Services refers to any automated features or content generated by artificial intelligence, including conversation summaries and suggested questions, provided by MoneyFitt.
• Personal Information refers to personally identifiable information such as name, email, phone number, etc., which is only shared with Advisors with the User’s explicit consent, in compliance with Singapore’s Personal Data Protection Act (PDPA).
• Lead refers to a User who consents to share their contact details with an Advisor after being matched through the Platform.
• Onboarding Process refers to the set of initial questions asked of Users to gather financial preferences and needs in order to facilitate matching with Advisors.

LICENCE TO USE THE PLATFORM 

MoneyFitt grants Users a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform for personal, non-commercial purposes, subject to compliance with these T&C. The use of the Platform is conditional on adherence to the following restrictions:

• Prohibited Actions: Users may not modify, copy, adapt, reproduce, distribute, publish, transmit, or create derivative works based on the Platform without express written permission from MoneyFitt.
• Users are prohibited from reverse-engineering, decompiling, or disassembling any part of the Platform.
• Users must not engage in any unlawful activities or actions that compromise the security, integrity, or performance of the Platform.
• Users may not attempt to circumvent the Platform’s processes, including attempts to solicit personal contact information to Advisors outside of the designated ‘share contact’ feature.

Enforcement: Any violation of this licence may result in the suspension or termination of the User’s access to the Platform and potential legal action by MoneyFitt to protect its intellectual property rights.

USE OF THE PLATFORM

The Platform offers the following services to Users:

• Expert Matching: Users are matched with up to three Advisors initially based on their responses to the onboarding process.
• Chat Functionality: Users may initially communicate with Advisors via the Platform’s messaging feature.
• AI-Generated Content: The Platform may provide AI-generated suggestions, conversation summaries, or other unbiased informational tools to assist Users in interacting with Advisors.
• Educational Resources: Users are provided with unbiased informational resources to improve their financial well-being. 

Users agree to the following conditions when using the Platform:

• User Commitments: Users are responsible for providing accurate, complete, and truthful information during the onboarding process.
• Users may not use the Platform for any unlawful purposes or engage in any activity that violates these T&C.
• Age Requirement: Users must be at least 18 years old to access the Platform.
• Users acknowledge that all interactions with Advisors are third-party and unaffiliated with MoneyFitt, and MoneyFitt is not liable for any decisions made as a result of those interactions.

MoneyFitt reserves the right to terminate access to the Platform if a User violates these T&C or engages in activities detrimental to the Platform’s integrity.

ADVISORS’ ROLE

Advisors listed on the Platform are third-party contractors and are not employees, agents, or representatives of MoneyFitt. The role of the Platform is strictly to facilitate the connection between Users and Advisors. MoneyFitt does not supervise, control, or endorse the advice, services, or actions provided by Advisors. Users are solely responsible for assessing the suitability of any Advisor..

• Independence: Advisors operate independently and are solely responsible for the services and advice they provide.
• Liability Disclaimer: MoneyFitt expressly disclaims any and all liability arising from the actions, advice, or recommendations provided by Advisors. Users are encouraged to verify the qualifications and advice of Advisors independently before making any financial decisions.
• Prohibited Conduct: Advisors are prohibited from soliciting personal contact information from Users outside of the Platform’s ‘share contact’ feature. Any Advisor found violating this rule will be immediately terminated from the Platform.

USER RESPONSIBILITIES

By accessing or using the Platform, Users agree to the following responsibilities:

• Accurate Information: Users must provide accurate, complete, and up-to-date information during the onboarding process. Falsifying or providing misleading information may result in the suspension or termination of access to the Platform.
• Compliance with Laws: Users agree to comply with all applicable laws and regulations when using the Platform.
• Respect for Platform Integrity: Users must not engage in activities that compromise the security, performance, or integrity of the Platform, including attempting to bypass or manipulate the Platform’s processes.
• No Circumvention: Users must not attempt to contact Advisors outside of the Platform's designated channels without using the 'share contact' feature. Soliciting or sharing personal information outside the Platform before the use of the ‘share contact’ feature constitutes a breach of these T&C.
• AI-Generated Content: Users acknowledge that AI-generated content, such as conversation summaries and suggested questions, is informational and should not be relied upon as professional financial advice.

By using the Platform, Users accept full responsibility for any decisions made as a result of interactions with Advisors, and MoneyFitt is not liable for any consequences arising from such decisions.

AI-GENERATED CONTENT

MoneyFitt provides AI-generated content to assist Users in interacting with Advisors. This may include, but is not limited to:

• Suggested Questions: Recommendations for inquiries Users might want to pose to Advisors, based on their financial needs.
• Conversation Summaries: Automated recaps of interactions with Advisors, highlighting key points discussed.
• Informational Prompts: General information and tips related to financial literacy and well-being.

To enhance the quality and relevance of these features, anonymised insights may be derived from user-advisor interactions on the Platform. This process enables our AI to deliver more tailored assistance based on patterns and common themes in financial advisory interactions, ensuring that AI suggestions remain valuable and contextually appropriate for User needs.

Informational Purposes Only: All AI-generated content is provided solely for informational purposes and does not constitute financial advice or as a substitute for advice provided by a qualified financial professional. Users are encouraged to verify any information generated by the AI independently and consult with professional advisors as needed. MoneyFitt makes no guarantees regarding the accuracy, completeness, or reliability of AI-generated content. Users assume full responsibility for any actions taken based on such content.

SHARING OF INFORMATION

MoneyFitt respects the privacy of Users and shares personal information with Advisors only when explicitly authorised by the User. The Platform’s data-sharing practices include:

• Personal Information: MoneyFitt shares a User’s name, email, phone number, or other personally identifiable information with Advisors only when the User clicks the ‘share contact’ button.
• Non-Personal Information: Information related to Users' financial needs and preferences may be shared with Advisors to facilitate personalised advice, excluding personal contact details unless explicitly shared.
• User Consent: By using the Platform, Users consent to share non-personal information with Advisors for matching purposes and control what personal information is shared. In addition to sharing information with Advisors when Users explicitly consent, MoneyFitt may access the content of conversations primarily for AI functionality enhancement, quality control, and compliance purposes.
• Personal Data Protection: MoneyFitt is committed to protecting your personal information under the Personal Data Protection Act (PDPA) of Singapore. We will:
  • Collect, use, and disclose personal information only for the purposes outlined in these T&C and our Privacy Policy.
  • Safeguard personal information from unauthorised access or misuse.
  • Respect your rights regarding your personal data, including access and correction.

MoneyFitt is not responsible for any misuse of information once shared with Advisors. Users should exercise discretion when sharing personal information.

PAYMENTS AND FEES

MoneyFitt operates as a subscription and lead-based service for Advisors:

• Advisors’ Fees: Advisors pay subscription fees for Platform listing and access to matching services, along with additional fees based on user engagement.
• No Commissions: MoneyFitt does not take any commissions from financial transactions, products, or services resulting from interactions between Users and Advisors. The matching process is unbiased and not influenced by financial incentives from Advisors.

MoneyFitt reserves the right to modify the fee structure at any time. Changes to fees will be communicated to Advisors in advance and will be reflected in these T&C.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, MoneyFitt, its directors, officers, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, financial losses, loss of goodwill, or other intangible losses arising from your use of the Platform.
• The actions, advice, or services of any Advisor accessed through the Platform.
• Any reliance on AI-generated content provided by the Platform.
• Unauthorised access to or alteration of your data.
• Any technical issues, downtime, or data loss affecting the availability of the Platform.

MoneyFitt provides the Platform as a neutral intermediary for Users and Advisors to connect. As such, MoneyFitt assumes no responsibility for the financial decisions made by Users or the advice given by Advisors. Users assume full responsibility for their actions and decisions made as a result of interactions on the Platform.

INTELLECTUAL PROPERTY

All content, materials, software, trademarks, logos, service marks, and intellectual property displayed on or accessible via the Platform are the property of MoneyFitt or its licensors, and are protected by intellectual property laws. This includes but is not limited to:

• Text, graphics, logos, user interfaces, visual interfaces, photographs, trademarks, sounds, music, artwork, and computer code.
• The design, structure, selection, coordination, expression, look and feel, and arrangement of such content.

Users are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial purposes, subject to these T&C. Users may not:

• Modify, copy, reproduce, republish, upload, post, transmit, distribute, or create derivative works of any part of the Platform without prior written consent from MoneyFitt.
• Reverse-engineer, decompile, disassemble, or attempt to discover the source code of the Platform.

Any unauthorised use of the intellectual property owned by MoneyFitt will result in termination of access to the Platform and may lead to legal action.

TERMINATION

MoneyFitt reserves the right, at its sole discretion, to terminate or suspend your access to the Platform at any time, without notice or liability, for any reason, including but not limited to:

• Breach of these T&C.
• Providing false, inaccurate, or misleading information.
• Engaging in activities that compromise the security, performance, or integrity of the Platform.
• Attempting to solicit personal contact information outside of the Platform’s 'share contact' feature.

Upon termination, your right to use the Platform will cease immediately. MoneyFitt may delete your account, including any data or content associated with it, without liability or further obligation to you. MoneyFitt assumes no responsibility for any losses or consequences arising from the termination of your access to the Platform.

GOVERNING LAW

These T&C, and any disputes arising from or relating to them or the use of the Platform, shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts of Singapore for any disputes arising out of or related to these T&C or your use of the Platform.

MoneyFitt makes no representation that the services or content available on the Platform are appropriate or available for use outside Singapore. Users accessing the Platform from other locations do so at their own risk and are responsible for compliance with local laws.

CHANGES TO THE T&C

MoneyFitt reserves the right to modify, update, or amend these T&C at any time. Any changes will be effective immediately upon posting the revised version on the Platform. It is your responsibility to review these T&C periodically for updates.

MoneyFitt may notify you of significant changes to these T&C via email or through notices on the Platform, but your continued use of the Platform after changes are posted constitutes acceptance of the updated T&C. If you do not agree with any modifications, you must immediately cease using the Platform.

SEVERABILITY

If any provision of these T&C is found to be unlawful, void, or unenforceable, that provision shall be severed from these T&C, and the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These T&C, along with the Privacy Policy, represent the entire agreement between you and MoneyFitt concerning your use of the Platform and supersede all prior agreements, communications, and understandings, whether written or oral.

USER INDEMNIFICATION

You agree to indemnify and hold MoneyFitt and its affiliates, directors, officers, employees, and agents harmless from and against any claims, actions, demands, liabilities, and settlements, including without limitation reasonable legal fees, resulting from or alleged to result from your violation of these T&C, your use of the Platform, or any advice or services provided by Advisors.

ELECTRONIC COMMUNICATIONS

By using the Platform, you consent to receive communications from MoneyFitt electronically. These communications may include notices about your account and information concerning or related to the Platform. You agree that any notices, agreements, disclosures, or other communications that MoneyFitt sends to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
